A couple from Golders Green is considering invoking the Human Rights Act after developers were given permission to build flats above their home.

Douglas and Barbara Gardener said they were "devastated" after the planning inspectorate gave the green light for the Logstart Limited development at Heathway Court, Finchley Road.

After three appeals, when Barnet Council refused the scheme, the company has been told they can go ahead to convert roofspace at the block into four flats.

Mrs Gardener said: "We intend to apply to the High Court to have the inspector's decision quashed.

"We are totally against the development because we think our human rights as owners of the flat below will be violated.

"Our flat is right in the middle of the development which means flats being above us and all around us."

Jonathan Glanz, director of Logstart, said: "This process has run its course in a proper way. It has been considered by the council and various planning inspectors and as far as we are concerned they have done their job correctly."

He added: "These are not new points. They were made in respect of the third, second and first planning applications and the third, second and first appeals."
